Route 404 Accident Results in the Death of One Man

Earlier this month in Easton, one man was killed in a two-car accident on Route 404, near the area of Owens Road and US Route 50. According to one local news report, the fatal accident took place around 8:20 in the evening on July 5.

Evidently, a Buick was making a turn onto Route 404 from Owens Road when it was struck by a southbound BMW. The collision involved such force that the Buick essentially broke into pieces and caught fire. The BMW ultimately came to a rest upside-down in a nearby ditch. The driver of the BMW and his passenger were both taken to nearby hospitals, but the driver of the Buick was pronounced dead at the scene by emergency workers.

Police are conducting an investigation into the accident in hopes of learning more about what may have caused the fatal accident. No citations have been issued yet, but that may change as the investigation is concluded.

Dangerous Maryland Roads and Driver Liability

Route 404 is known as one of the more dangerous two-lane highways in Maryland, partially because it gets so much use from motorists using it to get to the Delaware beaches. While widening the road and creating a divider has been a priority in recent years, the cost of performing the project is holding back progress. Roughly 100 people have lost their lives on this dangerous stretch of road since it was created back in the 1950s.

It is important to note, however, that regardless of how dangerous a highway is, drivers still have a duty to drive safely when on the road. In fact, a driver’s duty to maintain a safe speed and operate their vehicle in a responsible manner never ceases. When a driver fails to live up to this standard, they may be held responsible by anyone injured as a result of that driver’s negligence.

Recovering in Maryland Car Accidents

In order for an accident victim to be successful in a lawsuit against an allegedly negligent driver, the accident victim must prove that the other driver’s negligence resulted in their injury. In addition, since Maryland subscribes to the doctrine of “contributory negligence,” the accident victim must also be free of all fault, or he may be precluded from financial recovery. It is therefore very important that a skilled attorney be brought on board early in the process to prevent the unfair shifting of blame by the defendant or their insurance company.

Have You Been Injured in a Maryland Car Accident?

If you or a loved one has recently been involved in a serious Maryland car accident, you may be entitled to monetary damages based on another driver’s negligence. However, as discussed above, a savvy defendant may be able to completely escape liability by shifting just a small portion of the blame onto you.
